Bankruptcy Questions
On your hearing date
you may be asked some or all of the questions below. Others may be asked also. Try to
relax. The people who perform this function have gone over these same questions hundreds
or even thousands of times. And you'll have your attorney at your side. Do not hesitate to
turn to him should any question confuse you in any way.
Typical
questions include:
State
your complete name and current address:
Is
the list of assets you've provided complete and accurate to the best of your knowledge?
Do
you own your own home or do you rent?
Have
you ever owned any real estate?
What
will you be doing with your present automobile? Will you be surrendering it or do you plan
to reaffirm the debt?
Are
you expecting any tax refund this year? If so - do you know the amount?
Do
you expect to inherit any money or property during the next year?
Have
you given away any gifts during the past six months?
Did
you carefully review all your bankruptcy schedules before you signed them?
Are
you still employed at ______ ?
Has
your income changed since you completed your schedules?
Have
your monthly expenses changed in any way?
Do
you expect any changes in your living expenses or income during the next six years?
Do
you own any income not listed in your schedules?
Do
you have any last minute changes to make on your schedules?
Have
you lived at your current address for the last three years?
Have
you ever owned a business or had any interest in one?
Have
you closed any bank or brokerage accounts during the past year?
Do
you have a safety deposit box? If so, what does it contain?
Have
you made any purchases or cash advances against your credit cards during the past 90 days?
Your lawyer will probably tell you to keep your answers short and sweet. Do not provide
any more detail than is minimally required. Do not give background information. Do not
make excuses for your situation. Just stick to the facts.
